Use.

These terms govern your use of the Kilter website at www.kilter-app.com (the “Site”), operated by Timeless NYPO Tech Ltd(“we”, “us”). By using the Site you agree to them. If you don't agree, please don't use the Site.

The Site describes Kilter and lets you request a demo. Nothing on it is an offer to contract, a binding quotation, or professional advice. Any purchase, pilot, or use of the Kilter software is governed by a separate written agreement— see “The Kilter software” below. Where the two conflict, that agreement controls for the software.

Kilter is proprietary software, licensed and not sold. It is made available only under a written licence (and, where applicable, a pilot or evaluation agreement) between the customer and Timeless NYPO Tech Ltd. That agreement — not these Site terms — sets out the licence scope, fees, support, warranties, and liability for the software.

You may not copy, decompile, reverse-engineer, resell, or create derivative works of Kilter except as expressly permitted by your licence or by mandatory law.

• Don't attempt to disrupt, probe, or gain unauthorised access to the Site or its infrastructure.
• Don't scrape, copy, or republish Site content for competing commercial purposes.
• Don't misrepresent your identity or submit unlawful content through our forms.
• Don't submit confidential, regulated, or live production data through the demo or contact forms.

The Site and its contents — text, design, graphics, the Kilter name and logo, and the software — are owned by or licensed to Timeless NYPO Tech Ltd and protected by intellectual-property law. We grant you a limited, revocable, non-exclusive licence to view the Site for your own evaluation. No other rights are granted.

You're responsible for the accuracy of what you submit through the Site, and for ensuring you're permitted to share it. We handle personal data you provide in line with our Privacy Policy.

Performance figures on the Site — for example auto-match rates or time-savings drawn from specific deployments — are illustrative of past results in particular environments. They are not promises or guarantees of the results you will achieve.

The Site is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant that the Site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Timeless NYPO Tech Ltd will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Site. Nothing here limits liability that cannot lawfully be limited. Liability for the Kilter software is addressed in the relevant licence agreement.

The Site may link to third-party sites we don't control. We're not responsible for their content or practices, and a link is not an endorsement.

These terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction over disputes relating to the Site, without affecting any mandatory consumer protections available to you locally.

We may update these terms from time to time. The current version always lives at this URL, with the “last updated” date above. Continued use of the Site means you accept the updated terms.
